Home / Employment Law / Breaches of Modern Awards and Enterprise Agreements

Most employment relationships are governed by a modern award or an enterprise agreement. The rights contained within these instruments are in addition to any rights conferred upon you by your contract of employment and the National Employment Standards (NES). If an employee is included in the scope of a modern award or enterprise agreement, the existence of an employment contract will not void the minimum entitlements and conditions contained within a modern award, enterprise agreement or the NES.

The Fair Work Act makes imposes civil penalties for breaches of a modern award, enterprise agreement or the NES.

If you need assistance with determining the rights you hold under a modern award or enterprise agreement and commencing legal action for a breach of failing to provide those rights, then Sibley Lawyers can assist.
