There‘s moral as well as legal questions. Police are not directed to disrupt. However, they do have a duty to protect citizens, including criminals from crime in the community. Police also want to charge a criminal with an offence that will stick, and this will depend on issues of evidence and elements of the offence of attempt (and the NSW equivalent). In our view Police should have intervened in this case, but perhaps not by warning the victim as they had before, which may have led to more gang violence. - [18th time Disqualified Driving offender avoids actual imprisonment](https://sibleylawyers.com.au/traffic-law/18th-time-disqualified-driving-offender-avoids-actual-imprisonment/): Today a 38 year old man avoided jail in the Magistrates Court in relation to the charge of drive whilst disqualified. We fought hard to keep him out of prison. This would otherwise not be significant, except for the fact he had a record 17 prior offences for disqualified driving. Spanning a traffic history of 12 pages and a criminal history of 9 pages, he had what could only be described as a shocking history that included several dangerous operations of a vehicle, evade police, driving under the influence and the like. He had sadly developed an addiction to drugs just after school, and spent most of his adult life in and out of jail. His life was hopeless and negative, and remained in a negative spiral for most of his adult life. Having been released from prison in August of 2023, he drove his vehicle again in May of 2024. - [Employment Law: The Right to Disconnect](https://sibleylawyers.com.au/employment-law/employment-law-the-right-to-disconnect/): The recent changes to the Fair Work Act 2009 (Cth) (the ‘FW Act’) have introduced a new ‘right to disconnect’ for employees. Sibley Lawyers fought hard on behalf of 54 applicants and all Police, to have the forced medical procedure found unlawful. Many who for various reasons did not, or could not comply with those directions had been suspended without pay for over two years. Many had been dismissed from the Service. Some had sustained permanent injuries as a result of having the vaccine under the duress of an unlawful direction. - [Civil Liberties](https://sibleylawyers.com.au/legal-news/civil-liberties-2/): In the matter of the Police v Jackson Elliott, it was alleged that our client had seriously assaulted a police officer. In fact what had happened, was that JE went to the aide of his mate on the streets of Brisbane one evening, who was being dealt with excessively by two police, screaming in pain due to the handcuffs. - [Correctional Officer Acquitted After Lawful Restraint of a Prisoner](https://sibleylawyers.com.au/legal-news/correctional-officer-acquitted-after-lawful-restraint-of-a-prisoner-2/): In 2018 the legal fight for our client, a Corrective Services Officer commenced. It is therefore not unusual for things to get very messy, very quickly. In assault matters, whether or not the defendant was provoked, acting in self-defence or even whether the altercation was consented to by both parties, are factors that are considered by the court. - [Cautionary Message Regarding use of Force](https://sibleylawyers.com.au/legal-news/unlawful-arrest-and-false-imprisonment-by-police-at-southport-leads-to-dismissed-charges/): In the Magistrates Court of Southport, our client Mr Joel Helmore had his charges of Serious Assault Police and Commit Public Nuisance dismissed, following a finding that he had been unlawfully arrested and therefore was falsely imprisoned. - [Evade Police, Fail to Stop Defence](https://sibleylawyers.com.au/legal-news/evade-police-fail-to-stop-defence/): If you have been charged with an offence of failing to stop, under the Police Powers and Responsibilities Act section 754 (2) Fail to Stop Motor Vehicle, or given a notice under s 755 of the PPRA to identify the driver, you may have a good defence if you can establish on the balance of probabilities that you were not the driver. - [Woman charged with perjury after giving evidence at trial of man she claimed sexually assaulted her](https://sibleylawyers.com.au/legal-news/woman-charged-with-perjury-after-giving-evidence-at-trial-of-man-she-claimed-sexually-assaulted-her/): Woman charged with perjury after giving evidence at trial of man she claimed sexually assaulted her - [What Constitutes the serious criminal offence of drug trafficking at Southport and on the Gold Coast?](https://sibleylawyers.com.au/legal-news/what-constitutes-the-serious-criminal-offence-of-drug-trafficking-at-southport-and-on-the-gold-coast/): The serious criminal law charge of drug trafficking is these days far too quickly proffered against offenders in places like Southport and indeed elsewhere, when in previous years the criminal law offence of supplying drugs would have been preferred. - [Brisbane District Court Criminal Law Jurisdiction Sentencing for Sexual Assault](https://sibleylawyers.com.au/legal-news/12447-2/): The authorities that guide a District Court Judge in Brisbane to deal with the criminal law offence under s 352(1) of the Criminal Code of Indecent Assault when committed by a masseuse should be used to guide the range of sentencing. Recently the District Court in its criminal law jurisdiction in Brisbane dealt with the criminal offence of indecent assault in the context of a masseuse that had been found guilty of indecent assault by a jury after two trials for rape and indecent assault. At both trials the jury had been unable to make a finding of guilt for the rape, and only on the second trial was the finding of guilt delivered for the sexual indecent assault. The assault occurred when the defendant was massaging her while he was completing a massage inside a massage spa. While it is easy for a masseuse to avoid touching a patient in a sexual way, inadvertent touching can occur. The jury found the defendant guilty.  In Brisbane there must be many instances of inadvertent touching that do not constitute a criminal law offence. At the end of a criminal law trial, as happened her in Brisbane, the judge that ran the trial imposes the sentence. It must be a difficult thing for a judge to separate in their mind the things that the defendant was not found guilty of by the jury, and only sentence on the thing/s that they were. A judge is expected to be objective and put the things of their mind that they may have believed themselves. - [Burglary and Home Invasion Brisbane Criminal Defence Lawyer and Appealing Sentences](https://sibleylawyers.com.au/legal-news/burglary-and-home-invasion-brisbane-defence-lawyer-and-appealing-sentences/): In the Magistrates Court at Brisbane, like any other Magistrates Court, serious offences like Burglary and commit indictable offence under section 419(4) of the Criminal Code Queensland and Possessing dangerous Drugs under s 9 of the Drugs Misuse Act Queensland can easily result in jail time. The fact that the matter is at the Brisbane Magistrates Court level does not mean that serious penalties are not imposed for such criminal law offences. For example in 2016, a man suffering the ill-effects of taking Ice was charged with home invasion in Bundamba, part of the Ipswich district. He was eventually sentenced in front of the Brisbane Courts, to 30 months non-parole of 8 months, as criminal law offences can usually be shifted from one jurisdiction to another for a sentence. - [Brisbane Crime Lawyer defends criminal charge in Brisbane where one punch was thrown in self defence](https://sibleylawyers.com.au/legal-news/brisbane-crime-lawyer-defends-criminal-charge-in-brisbane-where-one-punch-was-thrown-in-self-defence/): Justin Sibley Brisbane Crime Lawyer and Williamson and Associates Lawyers Brisbane successfully defended an innocent man put on trial for assault occasioning bodily harm in Brisbane in circumstances where the police prosecutor should never have proceeded. - [Criminal Defence Lawyer helps Southport Defendant Resolve Criminal Assault Charges](https://sibleylawyers.com.au/legal-news/criminal-defence-lawyer-helps-southport-defendant-resolve-criminal-assault-charges/): Many cases of assault involve a he said she said version of events, and defending criminal assault charges at Southport Court is no different. In criminal assault cases, there are usually three sides to the story, the victim’s, the defendant’s and the truth being the third. It is often the case that what starts as a consensual fight between adults becomes an allegation involving the police by one party. Recently Justin Sibley criminal lawyer became involved in such a case involving a Chinese student. - [Criminal Lawyer helps Cleveland Defendant Resolve criminal charges of Home Invasion assault and motor vehicle offences](https://sibleylawyers.com.au/legal-news/criminal-lawyer-helps-cleveland-defendant-resolve-criminal-charges-of-home-invasion-assault-and-motor-vehicle-offences/): Justin Sibley crime lawyer recently reviewed a case of home invasion, assault and theft in company at Cleveland. Backed by fresh legislation and armed troops fitted out in coal-black uniforms, the Australian Border Force (ABF) was to epitomise an increasingly belligerent approach to policing a frontier that the then-Immigration Minister Scott Morrison termed a “strategic national asset.” - [Australian Border Force Intervention in Criminal Matters](https://sibleylawyers.com.au/legal-news/australian-border-force-imposes-their-own-justice/): Over the last 15 years or more, I have observed Australian immigration policy bring Australia into disrepute internationally, and help to fuel an ever growing problem of hatred towards the West and Australia in particular in the Middle East. - [Active Shooter Marauding Terrorist Firearms Attacks](https://sibleylawyers.com.au/legal-news/active-shooter-marauding-terrorist-firearms-attack/): Following on from our observations of the recent events in Paris and Jakarta, we were pleased to deliver a training session to a range of Country Risk Managers on ASMTFA at the Strategic Risk Forum in Singapore on behalf of NYA International at the request of AIG. - [Should Multiple Drink Driving Disqualifications result in Cumulative Sentences?](https://sibleylawyers.com.au/legal-news/12266-2/): Today we argued that s 90B of the Traffic Operations (Road Use Management) Act (TORUM) 1995 (Qld) does not mandate that two separate drink driving offences committed within a short period of each other must lead to cumulative disqualifications. Magistrate Carmody agreed and concluded that the sentencing function of the Magistrate is discretionary, and therefore the totality principle should be applied. - [Release of 60 Minutes Crew and mother Sally Faulkner sets up a Potential Diplomatic Incident](https://sibleylawyers.com.au/legal-news/release-of-60-minutes-crew-and-mother-sally-faulkner-sets-up-a-potential-diplomatic-incident/): The release on bail of the 60 Minutes crew, and the mother of the attempted victims of an abduction in Lebanon, may be kicking the can down the road in terms of impact. We would expect that the Lebanese judicial system will want these individuals to return to face Court, in the quite likely event that they will be indicted on some offences. - [Legal Issues in Lebanon](https://sibleylawyers.com.au/legal-news/legal-issues-in-lebanon/): The arrest of Sally Faulkner, the 60 Minutes crew led by Tara Brown and the representatives of a child recovery company in Lebanon demonstrate the need for careful consideration and expert knowledge prior to making decisions about the operation of laws in a foreign jurisdiction. One can only be knowledgeable about so many locations, and nothing beats a detailed familiarity of a particular location. - [Brussels Causes Inevitable Media Driven Search to Determine Whether Something was Missed](https://sibleylawyers.com.au/legal-news/brussels-causes-inevitable-media-driven-search-to-determine-whether-something-was-missed/): The very sad events in Brussels, like in Paris and elsewhere, has resulted in the inevitable media driven search to determine whether something was missed by law enforcement or intelligence agencies that could have prevented the attack. - [Justin Sibley – Specialist Consultant](https://sibleylawyers.com.au/legal-news/12236-2/): At the request of Saul Holt QC, Justin Sibley provided expert guidance on a recent terrorism case, and in particular assisted in preparing the cross examination of the expert witness. Justin Sibley is in a strong position to assist on these types of cases, as he tends to know the witnesses that the Australian Federal Police and ASIO rely on, and often knows as much about the region and the issues as they do. - [Farhad Jabar – Four Corners Program](https://sibleylawyers.com.au/legal-news/12219-2/): Written by: Justin Sibley  Published: 27 January 2015 - [Paris, a sign of things to come and an alternative rhetoric](https://sibleylawyers.com.au/legal-news/paris-a-sign-of-things-to-come-and-an-alternative-rhetoric/): Written by: Justin Sibley   Published: 18 November 2015 ## Pages - [Home v2](https://sibleylawyers.com.au/home-v2/): Your Shield in a Storm – Quality Legal Support, Made Affordable - [Opt Out](https://sibleylawyers.com.au/class-actions/qps/opt-out/): What is ‘Opt Out’? - [QPS Class Action Important Notice](https://sibleylawyers.com.au/class-actions/qps/info/): On 25 October 2024, a representative proceeding or class action was commenced in the Supreme Court of Queensland by Della Merrett, Shane Pokai and Deborah Pokai (“Lead Plaintiffs”) on their own behalf and on behalf of all persons who are a “Group Member” as defined in the proceeding (see below) against the State of Queensland (Queensland Police Service) (“First Defendant”) and the former Queensland Police Commissioner, Katarina Ruzh Carroll APM (“Second Defendant”). - [QAS Class Action](https://sibleylawyers.com.au/class-actions/qas/): In late 2021 and early 2022, the Director-General of the Queensland Department of Health issued directions to QAS officers to receive specified doses of a COVID-19 vaccine. This process ensures that each party receives a fair share of the property and debts, considering the contributions and future needs of each party. - [Criminal Confiscations](https://sibleylawyers.com.au/criminal-lawyers/criminal-confiscations/): Some offences tend to result in the State seeking to seize your assets. The initial phase of this could simply be an order to freeze your assets, placing you under enormous financial difficulty. - [Appeals](https://sibleylawyers.com.au/criminal-lawyers/appeals/): Magistrates, Judges and Juries as finders of fact do get it wrong. Appeals from decisions of Magistrates proceed to a single Judge of the District Court. You have one calendar month to appeal. These are conducted as re-hearings, and it is possible to appeal against both a conviction and the sentence. These appeals are without leave, and are quick and simple to undertake. Appeals following a jury decision, or a decision of a District Court Judge are by appeal to the Court of Appeal. - [Sick Leave/Personal Injuries and TPD](https://sibleylawyers.com.au/essential-services/sick-leave-personal-injuries-and-tpd/): As an essential services member, whether of the QPS, QAS or QCS, you may have been injured at work. Sometimes those injuries are obvious and sometimes they will be invisible to the naked eye. If you are unable to work due to an injury at work, you may have a claim against your employer due to their failure to provide a safe system of work. - [Bail Applications](https://sibleylawyers.com.au/criminal-lawyers/bail-applications/): You are entitled to the presumption of innocence, as well as the presumption of bail where bail has been objected to by the police. It is often the case that bail is objected to quickly, without proper consideration to the merits of the objection. Bail applications require appropriate evidence to support the application, and careful advocacy. Police often make extraordinary claims in sworn affidavits, which should not just be accepted. The impact that deprivation of liberty has on a person is extreme. - [Work Licence](https://sibleylawyers.com.au/traffic-law/work-licence/): Need a work licence to keep your job? It's an application that allows you to continue driving under certain conditions, even if you're facing a potential licence suspension in limited cases.
